"Seller" means Earthbend Herbals, the website http://www.earthbendherbals.com and all persons associated with it; "Buyer" means the invidual, firm, company or other legal entity purchasing the Goods from the Seller; "Goods" means the goods, products, material, or extract which are the subject of the Contract; "Contract" means an agreement made between the Seller and Buyer for the sale of Goods; The Buyer agrees to all the conditions contained in this Contract when visiting the Seller or purchasing Goods from the Seller and understands he/she will be legally bound to the Terms & Conditions in this Contract. The Seller , nor any of its directors, employees, or agents will be liable for damages of any kind arising out of or in connection with the use of this site or its Goods, including, but not limited to, being consumed either by the customer or any third party, compensatory, direct, indirect, or consequential damages. Consumption includes any type of internal ingestion such as oral or sublingual ingestion, smoking, insufflations, or any type of injection or trans-dermal application. The Buyer will take full responsibility for any Goods purchased or given as free samples from the Seller. This applies to any and all damages, personal injury, and legal fees that the Buyer may incur as a result of misuse of the Goods, whose range of application is explicitly limited in this Contract. The seller, while always attempting to abide by the laws of the State of West Virginia and of the United States of America, cannot and is not making any claims as to the legality of any of the products sold. It is the customer’s sole responsibility to comply with all laws and regulations of the particular jurisdiction which the customer is in. The Buyer is wholly responsible for being aware, understanding, and obeying local laws and regulations with respect to the Goods purchased from the Seller. The offer of the Goods by the Seller is void where prohibited. Any complications with Goods in transit which are due to a failure to observe applicable laws and regulations are entirely the responsibility of the Buyer. The Buyer certifies that their billing and shipping information are their own and not those of a third party, related or unrelated. The Seller allows billing and shipping addresses to be distinct in the instance that the Buyer has done sufficient business with the Seller, subject to the discretion of the Seller. Under no circumstances will the Seller accept distinct names for billing and shipping from the Buyer. The Seller will make every reasonable effort to assure the Goods are shipped to the Buyer in a timely fashion. In the event there is a delay, the Buyer acknowledges the Seller is not liable for such delay and the Seller will alert the Buyer of the delay. The Buyer understands that all sales are final once the Buyer or any third party has opened the package and Seller will not accept the products for return or refund. Buyer must also send us an email at orders@earthbendherbals.com with Buyer's Name, Address, and Order # and reason for return. This gives Seller prior knowledge of the returning package. Once Seller receives the returned package, Seller will make sure all contents are in tact and haven’t been tampered with and issue the refund immediately. All returns must be made within 5 business days of delivery or considered null and void and no return/refund will be accepted. If Buyers order arrives and it is the wrong quantity or type, Seller will gladly replace and exchange your order for the correct one. If your order arrives damaged or is lost in transit due to shipping fault, unfortunately, that responsibility resides with the shipping company and Seller can’t issue a refund or return. Insurance for any order is available when checking out or incorporated within the shipping option you choose at checkout. This provides you a course of action to get refunded up to a certain amount from the shipping company. What ever the case, PLEASE don't make a charge back for the order. Although the information from the Seller accessible worldwide, not all products or services discussed by the Seller are available to all persons or in all geographic locations or jurisdictions. The Seller reserves the right to limit the provision of Goods to any person, geographic area, or jurisdiction the Seller so desires and to limit the quantities of any Goods the Seller provides.
